# Jack Smith Report > [!abstract] 🏛️ Official government report > **Issued by:** Special Counsel [[Jack Smith]], [[Department of Justice]] · **Legal basis:** 28 C.F.R. § 600.8(c) · **Volume I made public:** early January 14, 2025 · **Volume II:** never released — see [[Jack Smith Report Volume II]] Smith's final report came in two volumes, one for each of his prosecutions of [[Donald Trump]]. Both cases had been dismissed after the 2024 election under the Department's policy against prosecuting a sitting president, and Smith resigned days before the release. ## Volume I — the election case About 170 pages on the effort to overturn the 2020 election: the pressure campaign on state officials and on Vice President [[Mike Pence]], the [[Fake Electors Scheme]], and the [[January 6 Capitol Attack]]. Its central sentence: "but for Mr. Trump's election and imminent return to the Presidency, the Office assessed that the admissible evidence was sufficient to obtain and sustain a conviction at trial." Trump called it "fake findings." Attorney General [[Merrick Garland]] released Volume I to Congress and the public; Volume II was held back. ## Volume II — the documents case The volume on the [[Mar-a-Lago Documents Case]] was never made public. It was withheld while proceedings against Trump's co-defendants were live; on January 21, 2025, Judge [[Aileen Cannon]] barred the Department from releasing it outside DOJ, and she reaffirmed the order in February 2026. That fight is its own story: see [[Jack Smith Report Volume II]]. ## How it is cited Volume I is the only official, prosecutor-signed account of the January 6 case that will exist, because the case never reached trial. That makes its "sufficient to obtain and sustain a conviction" line the closest thing to a verdict the record contains — and a claim that no court ever tested. ## See Also - [[Jack Smith]] · [[Jack Smith Report Volume II]] · [[Mar-a-Lago Documents Case]] · [[Special Counsel]] · [[Reports Hub]]
