# Enabling Act of 1933
The **Enabling Act** (March 23, 1933) — formally the "Law to Remedy the Distress of People and Reich" — is the legal instrument by which German democracy abolished itself. Five paragraphs long, it authorized [[Adolf Hitler]]'s cabinet to enact laws **without the Reichstag, without the president, and without conformity to the constitution**. It is the paradigm case of a legislature voting itself out of existence under legal forms — the terminal step of the capture sequence that began with the [[Reichstag Fire]] decree — and the reason "enabling act" is a permanent term of warning in constitutional politics.
## What It Did
The act transferred full legislative power to the cabinet for four years (renewed thereafter; effectively permanent), expressly including the power to deviate from the constitution. Combined with the still-operative Reichstag Fire Decree, it ended any institutional check on the executive: thereafter the regime legislated by fiat — including the [[Nuremberg Laws]] and the entire legal architecture of the racial state — while the Reichstag survived only as a ceremonial applause chamber that met a handful of times to hear speeches.
## How It Passed
Constitutional amendment required a two-thirds vote, which the NSDAP did not have even with its DNVP coalition partner. The supermajority was manufactured:
- The Reichstag Fire Decree's mass arrests removed the **Communist Party's 81 deputies** entirely; the rump chamber's quorum rules were rewritten so absent (arrested or fled) deputies counted as present.
- The vote took place in the Kroll Opera House ringed and filled with **SA and SS men**, with deputies walking through chanting stormtroopers to reach the chamber.
- The **Centre Party** — the Catholic swing bloc — was bought with verbal assurances about church prerogatives and judicial independence, none honored.
- Only the **Social Democrats** voted no, 94 deputies, after chairman Otto Wels delivered the republic's epitaph to Hitler's face: "Freedom and life can be taken from us, but not honor."
Final tally 444–94. The forms of legality were preserved at every step — which was precisely the strategy, giving the civil service, judiciary, and army the legal cover they wanted for obedience.
## Why It Matters for the KB
**The legal self-abolition template.** The act is the proof case that the destruction of constitutional government can be accomplished *by* constitutional procedure — intimidation supplying what arithmetic could not, and legality laundering the result. It is the fixed reference point for analyzing delegation of legislative power under emergency framing, court-stripping, and any maneuver by which a legislature is induced to surrender its function.
**The complicity mechanism.** Every actor who voted yes had a rationalization: the emergency was real, the assurances were credible, refusal was futile, others would be worse. The Centre Party's bargain — institutional concessions in exchange for constitutional surrender — is the standing model of accommodationist failure.
**The vocabulary.** "Enabling act" recurs wherever executives seek open-ended delegated power. The page anchors the term to the actual mechanism: not a coup, but a vote.
