# Detainee Treatment Act **Status: stub — expand.** Enacted **December 30, 2005**. Two halves that pull in opposite directions: it prohibited cruel, inhuman or degrading treatment of anyone in U.S. custody and limited interrogation to techniques in the Army Field Manual — and it **stripped federal courts of jurisdiction** over habeas petitions from Guantánamo detainees, substituting limited D.C. Circuit review of Combatant Status Review Tribunal determinations. **Why it matters:** Congress's answer to [[Rasul v. Bush]]. Because *Rasul* had been a statutory holding, amending the statute was enough — until [[Hamdan v. Rumsfeld]] read the DTA as not applying to pending cases, and [[Boumediene v. Bush]] held the substitute review inadequate. ## See Also - [[Habeas Corpus Timeline]] · [[Habeas Corpus]] · [[Suspension Clause]]
