# Trump v. Boyle
**25A11, decided 23 July 2025.** An emergency-docket order staying a district court ruling that had reinstated three Democratic commissioners of the Consumer Product Safety Commission — Mary Boyle, Alexander Hoehn-Saric and Richard Trumka Jr. — whose statute permits removal only for neglect of duty or malfeasance in office. The Court granted the stay 6–3, saying the case was controlled by [[Trump v. Wilcox]]. Justice [[Elena Kagan]] dissented, joined by Justices [[Sonia Sotomayor]] and [[Ketanji Brown Jackson]], arguing that the Court was using the emergency docket to dismantle an agency's statutory independence without deciding anything.
**The order matters less for the commissioners than for one sentence about itself.** The Court wrote that although its interim orders are "not conclusive as to the merits," they nonetheless "inform how a court should exercise its equitable discretion in like cases." That is an instruction to the courts below: follow the unsigned order. A month later, in *NIH v. APHA* (21 August 2025), Justice [[Neil Gorsuch]] put it more directly still, writing that when the Court issues such a decision "it constitutes a precedent that commands respect in lower courts."
Taken together the two statements close a loop that had been open since the emergency docket began growing: orders that may carry no reasoning at all are now precedent that district judges are expected to apply. See [[Shadow Docket]] and [[How an Emergency Stay Application Moves Through the Courts]].
The removal-power question *Boyle* declined to decide was answered on **29 June 2026**, when the Court overruled [[Humphrey's Executor v. United States]] in [[Trump v. Slaughter]] while separately blocking the removal of Federal Reserve governor [[Lisa Cook]] in [[Trump v. Cook]].
