# Hamdi v. Rumsfeld
**Status: stub — expand.** Vote counts to be verified against Oyez before they are stated here.
A U.S. citizen held as an enemy combatant is entitled to notice of the basis for his detention and a meaningful opportunity to contest it before a neutral decisionmaker. The plurality found detention authority in the [[AUMF]] but rejected the claim that the executive's designation was unreviewable.
The line most often quoted from it is Justice O'Connor's: a state of war is not a blank check for the President.
**Why it matters:** establishes that the *fact of custody*, not the label attached to the prisoner, triggers process. Decided the same day as [[Rasul v. Bush]].
