# Hamdan v. Rumsfeld
**Status: stub — expand.** Vote counts to be verified against Oyez before they are stated here.
The Court held that the military commissions then operating at Guantánamo were not authorized by statute and violated both the Uniform Code of Military Justice and Common Article 3 of the [[Geneva Conventions]].
Congress responded within months by passing the [[Military Commissions Act]], which purported to authorize the commissions and to strip habeas jurisdiction over detainee petitions outright — the [[Ex parte McCardle]] move, repeated.
**Why it matters:** the clearest modern instance of the loop in which a court rules, Congress rewrites the statute, and the litigation restarts one level up.
