# Gundy v. United States
2019 Supreme Court decision that upheld, 5–3, the Sex Offender Registration and Notification Act's delegation to the Attorney General to decide how the Act applied to pre-Act offenders. Justice [[Elena Kagan]] wrote for a four-justice plurality applying the "intelligible principle" test. Justice Alito concurred only in the judgment and said he would reconsider the doctrine with a full Court. Justice [[Neil Gorsuch]], joined by Chief Justice [[John Roberts]] and Justice [[Clarence Thomas]], dissented and proposed a stricter test. Justice Kavanaugh did not participate. The case marked the high point of the [[Nondelegation Doctrine]] revival, which [[FCC v. Consumers' Research]] (2025) then declined to complete.
*Stub — expand with the Gorsuch test and Kavanaugh's later signals.*
