# Corporate Enforcement and Voluntary Self-Disclosure Policy > [!note] Stub > This is a short entry that hasn't been fully written yet. The Department of Justice's **first Department-wide** corporate enforcement policy, issued by the Office of the Deputy Attorney General and announced **10 March 2026**. It applies to all corporate criminal matters handled by the Department except antitrust violations under 15 U.S.C. §§ 1-38, and it extends to every component the framework the Criminal Division introduced in May 2025. Law-firm analysis of the announcement reports that it supersedes all component-specific and U.S. Attorney's Office-specific corporate enforcement policies then in effect; no effective date appears on the face of the document. Its three tiers: - **Part I — declination.** The Department "will decline to prosecute" where there was a qualifying voluntary self-disclosure, full cooperation, timely and appropriate remediation, and "no aggravating circumstances related to the nature and seriousness of the offense." The company pays all disgorgement, forfeiture, restitution and victim compensation. - **Part II — the "near miss" tier.** Where a company cooperated and remediated but its self-report fell short of a qualifying disclosure, or aggravating factors warrant a criminal resolution, the Department **shall** provide a [[Non-Prosecution Agreement]] absent "particularly egregious or multiple aggravating circumstances," allow a term of fewer than three years, **not** require a [[Compliance Monitor]], and give a fine reduction of 50-75% off the low end of the Sentencing Guidelines range. - **Part III — everything else.** Prosecutors keep discretion over form, term, obligations and penalty, with the reduction capped at 50%. The structurally notable feature is what the document does not contain: the phrases "deferred prosecution" and "plea" appear nowhere in it. The only resolution instrument the Department commits itself by name to providing is the one that is never filed in court.
