# Marty Lederman Professor at Georgetown University Law Center and a former attorney in the [[Office of Legal Counsel]], where he served in both the Clinton and Obama administrations. He writes on executive power, war powers, and the separation of powers, and is one of the legal academics whose commentary shaped the public argument over the 2025–26 domestic-deployment cases. His most consequential intervention in that fight came as an **amicus**. In [[Trump v. Illinois]] the parties had both proceeded on the assumption that "regular forces" in 10 U.S.C. § 12406(3) meant federal civilian law enforcement. Lederman's friend-of-the-court brief argued it meant the regular forces of the United States military. On 29 October 2025 the Supreme Court ordered supplemental briefing on precisely that question, and on 23 December 2025 the majority adopted the reading — a point Justice [[Samuel Alito]]'s dissent objected to on party-presentation grounds, noting the argument had come from an amicus rather than from the respondents. > [!note] Stub — fill out > This page was created as a stub on 2026-09-05 while building out [[Trump v. Audit and expand when convenient: his OLC tenure and the torture-memo withdrawal period, his Just Security and Balkinization writing, and his other amicus work in the executive-power cases. ## See also - [[Trump v.
