# James Clapper Director of National Intelligence from 2010 to 2017 and one of the three former officials — with [[John Brennan]] and [[James Comey]] — at the center of the right's argument that the Russia investigation was itself the real crime. Three episodes carry that argument: his 2013 Senate testimony on NSA surveillance, the January 2017 intelligence assessment on Russian interference, and the 2020 letter on Hunter Biden's laptop. In 2026 he has been subpoenaed in the Justice Department's [[Grand Conspiracy Probe]]; he has not been charged. ## The three episodes | Date | Episode | |---|---| | Mar 12, 2013 | Asked by Sen. [[Ron Wyden]] whether the NSA collected data on millions of Americans, he answered "not wittingly." After [[Edward Snowden]]'s disclosures he called it the "least untruthful" answer he could give in open session. Critics on the left and right cite it as perjury; he was never charged | | Jan 2017 | Oversees the intelligence community assessment that Russia interfered in the 2016 election to help Trump — see [[Russian Election Interference]] | | Oct 19, 2020 | Signs the letter by 51 former intelligence officials saying the Hunter Biden laptop story had "the classic earmarks of a Russian information operation." He later said Politico "deliberately distorted" it — the letter said it could not verify the emails | ## The reckoning (2025–2026) | Date | Event | |---|---| | Jan 20, 2025 | A Trump executive order revokes the security clearances of the laptop letter's signers, Clapper among them | | July 18, 2025 | DNI [[Tulsi Gabbard]] calls for Clapper, Brennan and Comey to be referred for prosecution over the 2017 assessment. (The CIA's own referral named Brennan, not Clapper) | | Apr 2026 | [[Joe diGenova]] takes over the probe, run through grand juries in South Florida; Clapper is subpoenaed | | July 28, 2026 | The Pentagon renames "Clapper Leadership Hall" at Defense Intelligence Agency headquarters | | Sept 2026 | diGenova resigns after five months with no charges; AP lists Clapper as subpoenaed, Brennan as a target, before Judge Aileen Cannon | > [!note] Status, precisely > Clapper is **subpoenaed, not a named target**. Only Brennan is confirmed as a target. Claims circulating online that Clapper has been "convicted" come from fabricated sites. ## Why it matters here Clapper's record gives both sides something real. The 2013 answer was misleading and he admitted as much; the 2020 letter lent former officials' authority to casting doubt on a story before anyone had checked the laptop. But the 2017 assessment's core finding — that Russia interfered — has been confirmed by the Senate Intelligence Committee, and the 2025–26 prosecution effort has so far produced subpoenas and resignations, not charges.
