# Jack Goldsmith
The [[Office of Legal Counsel]] head (Oct. 2003 – June 2004) who withdrew the torture memos — the only major institutional self-correction in OLC's history — then spent the next two decades as the sharpest conservative analyst of the executive-power machine he briefly ran. If [[John Yoo]] is the cautionary tale about OLC's power, Goldsmith is the proof that the office's norms only bind when its occupant chooses to be bound.
## Background
Born 1962. Washington & Lee, Oxford, Yale Law School; clerked for Judge J. Harvie Wilkinson and Justice Anthony Kennedy. Legal academic (Chicago, Virginia) specializing in international law skepticism — a bona fide movement conservative, which is what made his rebellion credible. Special counsel at the Defense Department (2002–03) before taking over OLC.
## Ten months at OLC
Goldsmith arrived to find the Yoo/[[Jay Bybee]] memos in force and concluded they were not merely wrong but indefensible:
- **Withdrew the torture memos** (2004) — an almost unheard-of repudiation of standing OLC precedent, done knowing it stripped legal cover from an operating [[CIA]] program.
- **[[Stellar Wind]]** — his refusal to recertify parts of the NSA's warrantless surveillance program triggered the March 2004 hospital-room confrontation (Ashcroft, Comey, Card, Gonzales) and a near-mass-resignation at DOJ.
- **Resigned June 2004**, the same day he finalized the withdrawal, having lasted under a year against White House pressure led by David Addington.
His memoir *The Terror Presidency* (2007) remains the best inside account of how OLC actually works under pressure — including his observation that fear of *future* prosecution, not law, drives officials to demand OLC cover ("get out of jail free cards").
## Second act: chronicler
Harvard Law professor since 2004; co-founded **Lawfare** (2010); co-authored *After Trump: Reconstructing the Presidency* (2020) with Bob Bauer, the standard reform blueprint after the first term. In February 2025 Bauer and Goldsmith coined **"radical constitutionalism"** for the second term's legal strategy — assert the maximal Article II claim, act immediately, dare the courts to catch up — the frame the vault uses on the [[Office of Legal Counsel]] page. Their *Executive Functions* newsletter is the running scorecard of OLC's current output, including the takedown of the Gaiser Venezuela opinion.
## Why he matters here
Goldsmith matters twice over: as the historical exception that defines the rule (OLC self-correction is possible but career-ending), and as the most credible living critic of the current OLC — a conservative institutionalist whose alarm cannot be dismissed as partisan. When Goldsmith calls an opinion lawless, it lands differently than when the ACLU does.
