# Emmet Sullivan
Senior United States District Judge for the District of Columbia, appointed by Bill Clinton in 1994 — and the judge most associated with holding the Justice Department itself to account.
## The Ted Stevens precedent
Sullivan presided over the 2008 corruption prosecution of Senator Ted Stevens. After the conviction, evidence emerged that prosecutors had withheld exculpatory material. Sullivan **vacated the conviction, dismissed the case, and appointed an independent investigator into the prosecution team's conduct** — an unusually aggressive judicial response to government misconduct, and the episode he has returned to since as a reference point.
He later drew national attention for refusing to rubber-stamp the Justice Department's motion to drop the Michael Flynn prosecution, appointing an amicus to argue against dismissal.
## The Epstein files case, 2026
In August 2026 Sullivan pressed Justice Department lawyers over continued withholding and redaction of Epstein records in litigation brought by journalist **Katie Phang**, seeking release of FBI documents and removal of redactions covering names of people who had emailed Epstein.
At a hearing on **13 August 2026** he invoked the Stevens prosecution directly and warned that non-compliance with court orders could lead to contempt proceedings — adding, of the consequences for the lawyers involved, *"That's not a threat. It's a promise. No one's in trouble. I'm just bringing it to your attention."*
## Why he matters for the KB
Sullivan is the vault's clearest example of **a judge treating the Justice Department as a party that can lie to him rather than as an officer of the court entitled to deference**. The traditional presumption of regularity — that government lawyers' representations are made in good faith — is doctrine, not observation, and Sullivan's Stevens experience is the case most often cited for why the presumption is rebuttable.
That makes him load-bearing for the vault's [[Department of Justice]] material at a moment when the presumption of regularity is doing heavy lifting in the administration's litigation posture.
