# Charles Breyer
**Status: stub — expand.**
Senior U.S. District Judge for the **Northern District of California**, appointed by [[Bill Clinton]] and confirmed in 1997. Younger brother of retired Supreme Court Justice Stephen Breyer; former member of the U.S. Sentencing Commission.
Presided over [[Newsom v. Trump]], the Los Angeles [[National Guard]] federalization case. He issued the June 12, 2025 temporary restraining order that was stayed within hours, and on **September 2, 2025** held after a bench trial that the deployment had violated the [[Posse Comitatus Act]] — rejecting the argument that 10 U.S.C. § 12406 supplies an exception to it, which he said would "nullify the Act."
