# Liberty Counsel
The more aggressive, less polished cousin of [[Alliance Defending Freedom]] in the Christian nationalist legal ecosystem. Founded in 1989 by Mat Staver and based in Orlando, Florida (with a Washington, D.C. office), Liberty Counsel litigates religious liberty cases, represents clients in culture-war flashpoints, and operates a lobbying arm that drafts and promotes model legislation.
## Why It Matters
Liberty Counsel occupies a specific niche: it takes the cases that are too hot, too marginal, or too openly confrontational for ADF's carefully curated litigation strategy. The most famous example was representing Kim Davis, the Kentucky county clerk who refused to issue same-sex marriage licenses after *[[Obergefell v. Hodges]]* in 2015. ADF declined to represent Davis; Liberty Counsel stepped in and turned the case into a national spectacle.
This makes Liberty Counsel the shock-troop legal operation of Christian nationalism — it pushes the boundaries while ADF maintains its institutional credibility. The two organizations serve complementary functions: Liberty Counsel tests how far the courts will go, and ADF follows up with more carefully constructed cases once the terrain is mapped.
## Core Operations
**Litigation**: Liberty Counsel handles cases involving religious liberty, anti-LGBTQ advocacy, pro-life issues, and opposition to vaccine mandates. During COVID, the organization became a primary legal force challenging mask mandates, vaccine requirements, and church closure orders.
**Liberty Counsel Action**: The organization's lobbying and policy arm, which drafts model legislation and works with state legislators on "religious liberty" bills. This operation parallels but is smaller than ADF's legislative work.
**[[Liberty University]] connection**: Mat Staver is a former dean of the Liberty University School of Law, giving Liberty Counsel a direct pipeline to Liberty's law graduates and the broader Falwell institutional network.
**SPLC hate group designation**: Like FRC and ADF, Liberty Counsel has been designated as an anti-LGBTQ hate group by the SPLC. Staver has compared anti-LGBTQ discrimination laws to the persecution of Jews under Nazi Germany.
## The Analytical Framework
Liberty Counsel's function in the ecosystem is **frontier litigation** — pushing the legal boundaries of religious exemptions further than the more strategic ADF would attempt. It's the organization willing to take on cases that might lose but generate media attention, mobilize the base, and shift [[the Overton window]] for future litigation. In military terms, ADF is the main force and Liberty Counsel is the advance scout.
The organization also demonstrates the layered nature of the Christian right's legal infrastructure. ADF ($100M+), Liberty Counsel (~$7M), and dozens of smaller firms create redundancy — even if one organization is discredited or defunded, the legal infrastructure persists.
