# Cassidy Hutchinson — News Log
Rolling chronological record of the Justice Department's grand jury investigation of [[Cassidy Hutchinson]], the star witness of the [[House Select Committee on the January 6th Attack]], over whether she lied to Congress. Structural changes get promoted to [[Cassidy Hutchinson]] and to the committee page.
The case is tracked on its own because it tests a specific mechanism. [[Joe Biden]]'s January 2025 preemptive pardons covered the committee's members and staff, but not the witnesses who were not staff. A counter-investigation that cannot reach the investigators can still reach the witnesses. This log records whether that route produces a charge, and what the charge rests on.
## Lane Rule
- **The Hutchinson matter**: grand jury activity, an indictment or declination, charges, the statements at issue, the referral's paper trail, her lawyers' filings and statements, trial dates. This lands **here**.
- **Other actions against the committee's members, staff or witnesses** (Cheney, other witnesses, attempts to test the scope of Biden's pardons) also land here when they arise from the same counter-investigation. Note each one as a separate thread.
- **The Republican select subcommittee's general work** (pipe bombs, Capitol security, the FBI) goes to [[Barry Loudermilk]] or the committee page, not here, unless it touches Hutchinson or the committee's witnesses.
- Wider DOJ-retribution stories where this is one thread among several stay in [[Trump Retribution Ecosystem]] or [[Trump Corruption News Log]].
## Standing Watch Items
- **Indictment or declination**: whether the D.C. grand jury returns a charge, and under which statute. The usual statutes for false testimony to Congress are 18 U.S.C. § 1001 (false statements), § 1505 (obstruction of a congressional proceeding) and § 1621 (perjury). The general five-year limitations period means her 2022 testimony ages out during 2027.
- **Which statements**: the March 2026 referral targets her testimony that Trump knew of the potential for violence and pressed ahead. As of October 8 no outlet had reported which statements prosecutors are pursuing. Do not assume it is the second-hand SUV account.
- **Who is running it**: the Civil Rights Division under [[Harmeet Dhillon]], not the D.C. U.S. Attorney's Office. Any explanation for that assignment.
- **The referral**: known to be [[Barry Loudermilk]]'s, co-signed by [[Jim Jordan]], early March 2026. Watch for release of its text and of the subcommittee records it relies on.
- **Grand jury pushback**: D.C. grand juries declined to indict in several politically charged cases in 2025. A "no bill" here would be a news event.
- **Spillover**: subpoenas to Cheney or to former committee staff, and any argument that Biden's pardons do not cover something.

## 2026-10-08 — DOJ takes Hutchinson's January 6 testimony to a D.C. grand jury
**Source:** CBS News; NBC News (via Election Law Blog); *Washington Post*
### 🔴 Structurally Significant
**The Justice Department is presenting evidence to a federal grand jury in Washington on whether Cassidy Hutchinson lied to Congress in her testimony to the January 6 committee. No indictment had been returned.** Per CBS, the case is being run by the Civil Rights Division rather than the D.C. U.S. Attorney's Office, and CBS could not learn why. Per NBC, quoted by Election Law Blog, prosecutors are weighing a charge of lying to Congress, but the case has not yet been presented for an indictment vote. Media reports attribute the case to Republican allies in the House, which matches the Loudermilk–Jordan referral of March 2026 (see entries below). None of the three outlets reported which statements are at issue. The new step is the grand jury; the investigation itself has been public since April, and Hutchinson acknowledged it in federal court on September 24.
The target is the one star witness left unprotected. Biden's preemptive pardons of January 20, 2025 covered the committee's members, its staff and the police officers who testified. Hutchinson was none of these. The road here ran through [[Barry Loudermilk]]: his December 2024 House Administration subcommittee report on [[Liz Cheney]]'s contacts with her, then the Judiciary select subcommittee he has chaired since September 2025, then the referral.

## 2026-09-24 — Hutchinson tells a federal court she is under DOJ investigation and will take the Fifth
**Source:** Newsweek (Sept. 29, 2026), reporting the court order
### 🟡 Notable
**In Trump's defamation suit against the BBC, a federal judge quashed the BBC's subpoena for Hutchinson's deposition. She had told the court that DOJ is investigating her and that she would invoke the Fifth Amendment.** Judge Jeffrey Kuntz's order calls her "presently the subject of a criminal investigation." He also cited her more than 30 hours of sworn congressional testimony and warned the BBC against a "fishing expedition." The BBC may try again only by explaining "in great detail" what changed. The filing does not say what the investigation concerns. This is the first time Hutchinson herself confirmed the probe on the record.

## 2026-04 — New York Times: DOJ has opened an investigation
**Source:** *New York Times*, as cited by Newsweek; 🟡 single-sourced here (the Times piece was not read directly)
### 🟡 Notable
**The *Times* reported that the Justice Department was investigating Hutchinson over her congressional testimony about Trump's knowledge of and actions around January 6, after a Trump ally in Congress accused her of lying.** That timing places the opening of the investigation within weeks of the March referral.

## 2026-03-06 — Loudermilk refers Hutchinson to DOJ; Jordan co-signs
**Source:** CNN (via KRDO); The New Republic
### 🔴 Major
**Rep. [[Barry Loudermilk]], who chairs the House Judiciary Committee's January 6 select subcommittee, referred Hutchinson to the Justice Department for "lying to Congress" in her summer 2022 testimony. Judiciary Chair [[Jim Jordan]] co-signed.** The referral targets her testimony that Trump knew of the potential for violence on January 6 and pressed ahead with efforts to rile up supporters. CNN described the limo account separately, as second-hand testimony that a Secret Service agent and a deputy chief of staff said they did not remember, and did not report it as part of the referral. Her current and former lawyers did not respond. This is the referral the October grand jury traces back to, and it completes the chain from Loudermilk's December 2024 report on [[Liz Cheney]].
