# Electoral College Process Flow The structural map of the presidential path: popular vote → state slates of electors → the December meeting → certificates to Congress → the January 6 joint session count → inauguration, with the contingent-election branch that runs when nobody reaches 270. This is the *machinery* page; [[Electoral College]] is the prose page on what the institution is and whom it advantages, and this map is additive to it. The whole flow was rewritten once, in December 2022. The [[Electoral Count Reform Act]] replaced the ambiguities of the 1887 [[Electoral Count Act]] that the 2020–21 effort tried to pry open — the presiding officer's supposed discretion, the optional safe harbor, the "failed election" escape clause, the possibility of competing slates. Reading this map against [[How a Midterm Election Is Certified]] gives the two halves of American election certification and their central asymmetry: **the presidential count has a federal statute; congressional elections have none.** Time-slice: the reformed statute as it stands in August 2026, with the 2028 calendar dates it produces. No officeholders are named — the process does not change with who holds the seats. > [!note] How to read this chart > `──▶` = the main path · `└─▶` = a branch, contest track, or workaround · `◇` = a decision point · `★` = a legally operative act · `✕` = a route that was closed or a result that fails. Everything inside the fence is plain text; wikilinks live in the prose, Notes, and See also. Bracketed dates are the actual 2028-cycle dates the statutory formulas produce. Bracketed `[ECRA]` marks a provision that exists because of the 2022 rewrite. ``` THE ELECTORAL COLLEGE — POPULAR VOTE TO INAUGURATION │ Legend: ──▶ main path └─▶ branch/workaround ◇ decision ★ legally operative ✕ closed │ Time-slice: law as of Aug 2026 · dates shown are the 2028 cycle │ ■ 0. The provision that changes outcomes is the expedited judicial review at step 3 — a named plaintiff, a fixed forum, an inverted three-judge panel weighted toward circuit judges, and a guaranteed expedited Supreme Court appeal designed to land before the electors meet. The [[Electoral Count Act]] of 1887 had no mechanism at all for a governor who refused to certify. The [[Electoral Count Reform Act]] built one, and gave standing to exactly one class of person. - **"One lawful certificate per state" is the sentence that kills the 2020 playbook.** The [[Fake Electors Scheme]] depended on Congress receiving two slates from the same state and having to choose. The rewrite makes the executive's timely [[Certificate of Ascertainment]] conclusive, so a second document is not a competing slate — it is a piece of paper with no statutory status. See [[January 6 Capitol Attack]] and [[John Eastman]] for the theory it was built to serve, and [[Mike Pence]] for the ministerial role now written into the text. - **The residual risk is the clock, not the theory.** Every closed door in this map was closed by making some step mandatory and conclusive. None of them compels a state executive to act *quickly* beyond the six-day deadline, and the expedited track still requires a candidate to sue, a panel to convene, and the Supreme Court to rule inside a window measured in days. A refusal that survives to December 19 is a different problem than a refusal in November. This is the presidential analogue of the pressure point identified in [[How a Midterm Election Is Certified]] — see also [[Election Denialism]]. - **Allocation is state law, and it is in play right now.** Winner-take-all appears nowhere in the Constitution. Nebraska's [[Electoral College]] split has been under sustained attack: **LR24CA**, a proposed state constitutional amendment reverting Nebraska to winner-take-all, **narrowly advanced from committee in July 2026** and would put the question to voters. Whether it reached the November 2026 ballot could not be confirmed from public sources at build time and is marked accordingly in the map rather than asserted. - **The compact crossed a threshold this year and is still short.** The [[National Popular Vote Interstate Compact]] stands at **18 states plus D.C. = 222 electoral votes** after **Virginia's enactment in April 2026** — 48 short of the 270 that would activate it. The vault's prose pages predate the Virginia addition. - **[[Moore v. Harper]] did not kill [[Independent State Legislature Theory]]; it bounded it.** State courts retain review of state legislative action on federal elections, but the Court reserved a federal check on state courts that exceed "the ordinary bounds of judicial review." The theory's most dangerous application — a legislature substituting its own electors after Election Day — is separately foreclosed by the ECRA's requirement that certification proceed under law enacted *before* Election Day. - **Officeholders:** none named, by design. This is an evergreen process flow. The current-events layer lives in the bracketed notes and in the Notes above. ## See also - [[Electoral College]] — the prose page: what the institution is and whom it advantages - [[How a Midterm Election Is Certified]] — the congressional half, and the statute that does not exist there - [[Electoral Count Reform Act]] — the 2022 rewrite this map describes - [[Electoral Count Act]] — the 1887 original it replaced - [[Certificate of Ascertainment]] · [[Certificate of Vote]] · [[Safe Harbor Deadline]] — the instruments - [[Contingent Election]] · [[Faithless Elector]] — the branches - [[Twelfth Amendment]] · [[Twentieth Amendment]] — the constitutional text - [[Chiafalo v.
