# Continuity of Government Structure
An ASCII-art map of the machinery that is supposed to keep the United States government functioning through a catastrophe that empties Washington — the policy directives that govern it, the succession and relocation arrangements for each branch, the physical and airborne sites, the devolution chain that moves authority to surviving staff, and the pre-drafted emergency instruments nobody outside the executive branch has ever read. Structure and statutory citations are as of **August 21, 2026**; named officeholders were web-verified on that date.
This is the structural companion to the [[Continuity of Government]] concept page, which covers the history and the civil-liberties critique. Where [[Presidential Line of Succession]] maps *who inherits the presidency and in what order*, this map is the wider frame: succession is only one of the four branches-and-functions problems that continuity planning has to solve, and it is the only one that has a clean statute behind it. The other three — a Congress that cannot reach a quorum, a Supreme Court that cannot reach six, and an executive branch that has to keep operating from somewhere other than its buildings — are handled by chamber rules, a single obscure section of Title 28, and a body of directives that is mostly classified.
> [!note] How to read this chart
> **■** is the whole program; **◆** marks a major layer; plain `├─` / `└─` are the components inside it. Dot leaders align the right-hand column. **★** marks the three points where the design depends on something that is *not* law — a convention, a chamber rule, or a classified document. **[bracketed]** notes are dated changes and caveats verified when written; **[unconfirmed]** means the fact could not be sourced and is deliberately not asserted. Names inside the chart are plain text — the code fence does not render wikilinks, so the linked versions live in the prose and the Notes below.

CONTINUITY OF GOVERNMENT — STRUCTURE OF THE FEDERAL CONTINUITY ENTERPRISE (as of Aug 21, 2026)
│ Three nested programs, one classified spine, and four branch-specific problems
│ ★ = the load-bearing piece is a convention, a chamber rule, or a classified document — not a statute
│
■ THE FEDERAL CONTINUITY ENTERPRISE
│
├─◆ 1. THE THREE NESTED PROGRAMS (the vocabulary everything else uses)
│ │
│ ├─ COOP — Continuity of Operations ....... one agency keeps performing its own essential functions
│ │ └─ scope: every federal executive department and agency, individually
│ ├─ COG — Continuity of Government ....... the branch as a whole keeps governing
│ │ └─ scope: survival of the executive branch's capacity to direct the nation
│ └─ ECG — Enduring Constitutional Government all three branches keep their constitutional roles ★
│ └─ scope: the only tier that names Congress and the courts — and the thinnest of the three
│
├─◆ 2. THE POLICY LAYER (who writes the rules)
│ │
│ ├─ NSPD-51 / HSPD-20 (May 2007) ......... the post-9/11 charter; annexes remain classified ★
│ ├─ PPD-40, National Continuity Policy ... issued July 15, 2016; the operative directive
│ │ └─ establishes the eight National Essential Functions (NEFs) all planning maps back to
│ ├─ Federal Continuity Directive (FCD) ... FEMA/ONCP, December 2023 — planning requirements
│ ├─ FCD — Program Management Requirements DHS, August 2024 — program-management requirements
│ └─ Continuity Guidance Circular (CGC) ... the non-federal analogue for state/local/tribal use
│ │
│ └─ WHO COORDINATES IT
│ ├─ National Continuity Coordinator the Assistant to the President for Homeland
│ │ │ Security and Counterterrorism, by designation
│ │ └─ Homeland Security Advisor ... Stephen Miller (since Jan 20, 2025)
│ │ [whether the NSPD-51 NCC designation formally attaches to him: unconfirmed]
│ └─ Executive agent .............. DHS, through the FEMA Administrator
│ ├─ FEMA Administrator ....... Cameron Hamilton (confirmed Aug 7, sworn Aug 10, 2026)
│ ├─ Secretary of Homeland Sec. Markwayne Mullin (sworn Mar 24, 2026)
│ └─ Office of National Continuity Programs (ONCP) — the FEMA directorate that
│ owns federal continuity guidance, training, and assessment
│ [FEMA has lost ~4,500 employees since Jan 2025 and rescinded its strategic
│ plan in May 2025 — GAO-26-108427, Aug 2026]
│
├─◆ 3. CONTINUITY OF THE PRESIDENCY (the one problem with a clean statute)
│ │
│ ├─ Presidential Succession Act of 1947 .. 3 U.S.C. § 19 — VP, Speaker, President pro tempore,
│ │ │ then the Cabinet in department-creation order
│ │ ├─ Vice President .................. JD Vance
│ │ ├─ Speaker of the House ............ Mike Johnson (R-LA)
│ │ └─ President pro tempore ........... Chuck Grassley (R-IA)
│ │ [an acting secretary not Senate-confirmed to the office is passed over — see the
│ │ succession map for the full ordered list and the current skip flags]
│ ├─ Twentieth Amendment, § 3 ............ president-elect dies or fails to qualify before noon
│ ├─ Twenty-Fifth Amendment ............... vacancy, temporary transfer, and inability
│ ├─ Designated survivor ................. a convention, not a law ★
│ │ └─ one eligible successor held away from any event gathering the whole line
│ └─ Nuclear command authority ........... survives with the office, not with the building
│ └─ carried on the airborne platforms in layer 5, not tied to any fixed site
│
├─◆ 4. CONTINUITY OF CONGRESS (the quorum problem — no statute, no amendment)
│ │
│ ├─ THE CONSTITUTIONAL CONSTRAINT
│ │ ├─ Art. I, § 5 ..................... "a Majority of each shall constitute a Quorum"
│ │ ├─ Art. I, § 2, cl. 4 .............. House vacancies filled ONLY by special election —
│ │ │ a governor cannot appoint a Representative
│ │ └─ Seventeenth Amendment ........... Senate vacancies MAY be filled by gubernatorial
│ │ appointment where state law allows — so the Senate
│ │ can be refilled in days and the House cannot
│ ├─ THE HOUSE'S ANSWER
│ │ └─ Rule XX, cl. 5(c) — "provisional quorum" ★
│ │ ├─ on catastrophic circumstances, quorum = a majority of the PROVISIONAL number
│ │ ├─ codified in the 108th Congress; re-adopted via H.Res. 5, 109th Congress
│ │ └─ [constitutionality never resolved — the Speaker declined to entertain the point
│ │ of order, leaving the House to judge its own rule]
│ ├─ THE SENATE'S ANSWER .................. none of comparable specificity; it relies on
│ │ gubernatorial appointment to rebuild membership
│ └─ THE REFORM THAT DIDN'T PASS
│ └─ Continuity of Government Commission (AEI + Brookings, 2002–2011)
│ ├─ proposed a constitutional amendment for temporary House appointments — not adopted
│ └─ proposed removing the Speaker and President pro tempore from the succession line
│
├─◆ 5. CONTINUITY OF THE JUDICIARY (one section of Title 28, and almost nothing else)
│ │
│ ├─ 28 U.S.C. § 1 ....................... nine justices; ANY SIX constitute a quorum
│ ├─ 28 U.S.C. § 2109 .................... if a direct appeal cannot be heard for want of a
│ │ quorum, the Chief Justice may remit it to the court
│ │ of appeals; other cases simply remain pending
│ ├─ no mechanism to replace justices .... Art. II appointment is the only route; there is no
│ │ emergency-appointment provision anywhere
│ └─ lower courts ........................ Judicial Conference / AO continuity planning;
│ special sessions may be held at alternate locations
│
├─◆ 6. THE PHYSICAL AND AIRBORNE LAYER (where the government goes)
│ │
│ ├─ FIXED SITES
│ │ ├─ Mount Weather Emergency Operations Center ... Bluemont, VA — FEMA-operated
│ │ ├─ Raven Rock Mountain Complex (Site R) ....... near Blue Ridge Summit, PA — DoD
│ │ ├─ Cheyenne Mountain Space Force Station ...... Colorado Springs, CO — NORAD alternate
│ │ ├─ Presidential Emergency Operations Center ... beneath the White House East Wing
│ │ └─ The Greenbrier (Project Greek Island) ...... congressional relocation site, WV —
│ │ exposed by press reporting in 1992
│ │ and decommissioned; NO announced successor
│ └─ AIRBORNE PLATFORMS
│ ├─ E-4B Nightwatch (NAOC) ................... 4 aircraft — the "doomsday plane"
│ ├─ E-6B Mercury (TACAMO / ABNCP) ............ airborne launch control and fleet comms
│ └─ E-4C SAOC replacement ................... Sierra Nevada Corp., $13B award Apr 2024
│ ├─ first test flight Aug 7, 2025; testing continues through 2026
│ ├─ planned fleet 6–8 aircraft, up from the 4 E-4Bs
│ └─ contract completion date July 10, 2036 — an 11-year overlap with the fleet it
│ replaces, which is the practical measure of how old the current one is
│
├─◆ 7. THE ESSENTIAL-FUNCTIONS STACK AND DEVOLUTION (how authority actually moves)
│ │
│ ├─ THE FUNCTION HIERARCHY
│ │ ├─ NEFs — National Essential Functions ...... eight, set by PPD-40; the national floor
│ │ ├─ PMEFs — Primary Mission Essential Fns .... an agency's functions that support a NEF
│ │ └─ MEFs — Mission Essential Functions ....... everything else an agency must keep doing
│ ├─ ORDERS OF SUCCESSION ...................... every agency must pre-designate at least
│ │ three deep for each key position
│ ├─ DELEGATIONS OF AUTHORITY .................. pre-signed, so a successor's power does not
│ │ wait on a new signature
│ └─ DEVOLUTION OF OPERATIONS .................. transfer of an agency's functions to
│ │ geographically separated personnel
│ └─ triggered when the primary staff and the alternate site are both unavailable —
│ the deepest fallback, and the least exercised
│
└─◆ 8. THE UNREVIEWED LAYER (the part with no external check at all) ★
│
├─ Presidential Emergency Action Documents (PEADs)
│ ├─ pre-drafted EOs, proclamations, and messages to Congress, held ready for execution
│ ├─ originated in the Eisenhower administration as part of nuclear COG planning
│ ├─ 56 in effect as of 2017, up from 48 two decades earlier
│ ├─ NOT ONE has ever been publicly released; ~6,000 pages withheld in full as classified
│ └─ no statutory basis, no congressional notification requirement, no judicial review
└─ classified annexes to NSPD-51 / HSPD-20
└─ the ECG annex — the tier that governs Congress and the courts — is among them
──────────────────────────────────────────────────────────────────────────────────────────────
WHERE THE STRUCTURE IS THINNEST — the four load-bearing pieces that are not law
──────────────────────────────────────────────────────────────────────────────────────────────
1. THE DESIGNATED SURVIVOR is a convention. Nothing compels it, and nothing sets who it is.
2. THE HOUSE'S PROVISIONAL QUORUM is a chamber rule of contested constitutionality, adopted
by the body that would be judging its own compliance with it.
3. THE JUDICIARY has a quorum floor and no way to refill below it. Six of nine, or nothing.
4. THE PEADs AND THE ECG ANNEX are classified documents that would govern the moment the
other three failed — and the branch they most directly constrain has never seen them.

## Notes
**Recent officeholder changes.**
- **FEMA has a Senate-confirmed Administrator for the first time this term.** [[Cameron Hamilton]] was confirmed **August 7, 2026** and sworn in **August 10, 2026**. He is the same official who was fired as acting administrator in May 2025, one day after testifying to Congress that FEMA should not be eliminated, and was then re-nominated in May 2026. Robert Fenton, acting since May 12, 2026, has been superseded. The vault's [[DHS Component Tree]] still carried FEMA as acting-led with Hamilton pending; that is now stale and is flagged here rather than silently rewritten.
- **Stephen Miller** has held the Homeland Security Advisor portfolio since **January 20, 2025**. The National Continuity Coordinator role attaches by directive to the Assistant to the President for Homeland Security and Counterterrorism; whether that specific designation formally sits with [[Stephen Miller]] in the current White House staff structure **could not be confirmed** from public sources and is marked `[unconfirmed]` in the chart rather than asserted.
- Succession-line officers re-verified as of August 2026: [[JD Vance]] (VP), [[Mike Johnson]] (Speaker), [[Chuck Grassley]] (President pro tempore). [[Markwayne Mullin]] remains Secretary of Homeland Security. The full ordered Cabinet list, including the acting-official skip flags, lives on [[Presidential Line of Succession]] and is not duplicated here.
**Current-state findings that bear on the structure.**
- **The agency that owns the federal continuity mission is the one being cut hardest.** GAO report **GAO-26-108427**, issued August 2026, found FEMA lost roughly **4,500 employees** since January 2025 through deferred resignation, probationary terminations, and attrition — with **2,545 separations between October 1, 2025 and May 16, 2026** against **134 hires** — and that FEMA and DHS allowed the reductions without assessing current or future workforce needs. FEMA also **rescinded its strategic plan in May 2025** and has operated without one since. The [[Office of National Continuity Programs]] sits inside that agency. GAO did not break out ONCP-specific losses, and this map does not claim one.
- **The Greenbrier has no announced successor.** The congressional relocation bunker at White Sulphur Springs was exposed by press reporting in 1992 and decommissioned. No replacement congressional relocation site has been publicly identified, which means the branch with the hardest continuity problem is also the one with no publicly known place to go.
- **The E-4B fleet is being replaced on a timeline that runs to 2036.** Sierra Nevada Corporation received a **$13 billion** award in **April 2024** for the **Survivable Airborne Operations Center**; the first E-4C flew **August 7, 2025**, testing continues through 2026, the planned fleet is **six to eight aircraft** against today's four E-4Bs, and the contract completion date is **July 10, 2036**.
- **Fifty-six PEADs were in effect as of 2017**, up from 48 two decades earlier. None has ever been released. The George W. Bush Presidential Library produced more than 500 pages of PEAD *review* material to the Brennan Center under FOIA while withholding roughly **6,000 pages in full** as classified. See [[Presidential Emergency Action Documents]].
**Structural caveats.**
- The three-tier vocabulary — COOP, COG, [[Enduring Constitutional Government]] — is the executive branch's own, from NSPD-51/HSPD-20. It is worth noticing that the tier covering Congress and the courts is the one defined last and specified least, and that its governing annex is classified.
- The House's [[Provisional Quorum]] rule is reproduced here as adopted, not as adjudicated. Members raised a constitutional objection when it was codified; the Speaker declined to entertain the point of order on the long-standing precedent that the chair does not rule on the constitutionality of a pending proposal. The question has never been tested.
- Emergency *powers* — the National Emergencies Act catalogue, the [[Insurrection Act]], the Stafford Act, IEEPA — are deliberately **not** mapped here. Continuity planning and emergency powers are adjacent but distinct: continuity asks who governs when the government is broken, emergency powers ask what a functioning government may do under a declaration. The statute-to-powers mapping belongs to the Emergency Powers Crosswalk, which is queued and unbuilt; [[National Emergencies Act]] carries the statutory frame in the meantime.
- Facility names are drawn from public reporting and declassified material. Current site rosters, capacities, and staffing are classified and are not asserted.
