# Palantir DoD Sole-Source Funding Memo
On **August 4, 2026**, Deputy Secretary of Defense [[Steve Feinberg]] signed a memorandum whose subject line was **"Funding Palantir."** It directs [[Department of Defense]] components to spend **up to $243.9 million** on [[Palantir]] software **through March 31, 2027**, and to identify options for further spending from **April 1, 2027 through December 28, 2028**. Feinberg's stated rationale is that the software is "providing valuable support to improve efficiencies with the defense industrial base," citing delays in munitions and delivery-vehicle production.
*The Register* obtained and reported the document on **August 11**. *Washington Technology* and Nextgov confirmed it independently on **August 12**, Defense One on **August 13**, and Federal News Network in the same window — so the memo is no longer single-sourced, which is the condition the vault's [[Spending Gap - Not Exclusive to Any Vendor vs. the Memo Titled Funding Palantir]] card attached to it at creation.
## What the document does not contain
This is the analytically load-bearing part, and it is an absence rather than a claim.
The memo names **no contract**, **no contract vehicle**, and **none of the Federal Acquisition Regulation's permitted sole-source justifications** — not unusual urgency, not single responsible source, not follow-on work, not national security. [[Project On Government Oversight]]'s Greg Williams flagged the omission that matters most: it never references **10 U.S.C. § 3204**, the statute requiring a written, certified justification before the department uses other-than-competitive procedures.
A directive to buy sole-source that does not cite the sole-source authority is not a procurement document. It is an instruction.
Asked about the memorandum, a Defense Department official called it **"standard practice"** under the department's BOND program and said the practice was **"not exclusive to any single vendor."** That is a defensible sentence about a program. It is not a defensible sentence about a document titled *Funding Palantir* that names one vendor, one ceiling, and one instruction.
## Why it matters: the template inverts
The pattern this vault has tracked across [[Palantir USDA One Farmer One File Contract]], [[Palantir ICE Systems]], and the NHS deployment runs in a fixed order: **sole-source justification → dataset consolidation → dependency**. Every step in that sequence produces a document, and every document is a handle — something that can be protested, FOIA'd, or litigated.
Here the department skips the first step entirely and issues a **spending instruction with a vendor name on it**. That is a different and legally weaker object than a Justification and Approval, and it removes the handle. The irony is precise and worth holding onto: three weeks before this memo, Palantir had forced the Defense Intelligence Agency to withdraw a solicitation by invoking procurement law against it (see [[Palantir DIA ASTRA Protest]]). **The company that litigated its way into agencies by insisting the rules be followed is now being funded by a document that declines to invoke any rule at all.**
It also reframes the growth question. The [[Palantir Watch Log]] has carried "which federal agency signs next" as a standing question, on the assumption that expansion happens agency by agency. A top-down directive telling existing components to find uses for a named vendor is a different growth vector — demand manufactured at the top rather than won at the bottom.
## Context: the no-bid baseline
- No-compete awards were **14.8% of all federal awards in H1 2026**, up from 12.6% a year earlier.
- GovTribe puts Palantir at **$3.2B in obligations since 2024**, roughly half of it no-compete.
- The trajectory of the [[Maven Smart System]] ceiling — from $480M in 2024 toward the multibillion range — is the shape this kind of authority takes over time.
- The [[Palantir $10B Army Contract]] consolidated roughly 75 separate agreements into one enterprise vehicle, which is the same logic applied to contracts rather than data.
## The conflict surface
Context, not causation — these facts establish who benefits, not that anyone acted on it:
- ProPublica's tracker documents **100+ administration officials** holding Palantir investments.
- [[Donald Trump]]'s 2025 financial disclosure lists at least **$1M** in Palantir.
- [[Peter Thiel]] is Palantir's board chairman; [[JD Vance]] is a Thiel protégé.
- [[Elizabeth Warren]] pressed Feinberg directly on contracting conflicts in a **July 2026** hearing, before this memo was written.
## Caveats — keep these attached
> [!warning] Do not report the ceiling as money spent
> "Up to $243.9M" is a **ceiling**, not an obligation. As of the August 24, 2026 sweep, **no award citing this direction had appeared on USASpending or SAM.gov**, and no row has been added to the [[Palantir Contracts]] ledger for that reason — a memo ceiling in a contract ledger would be a category error.
- The § 3204 analysis is POGO's characterization of a document the public has not seen in full. Attribute it.
- It is not publicly confirmed whether the direction has been finalized or whether any resulting award has been made.
- The memo is a *draft* per the original reporting; subsequent confirmations describe the document but not its final disposition.
## What would harden this
1. An award ID on USASpending or FPDS citing the direction — the point at which a [[Palantir Contracts]] ledger row becomes appropriate.
2. Any § 3204 justification released or obtained by FOIA.
3. A congressional follow-up citing the document by name; a Warren letter is the likeliest form.
4. Release of the memo's full text rather than reporters' descriptions of it.
