# Nuclear Option **Status: stub — expand.** The **nuclear option** is the maneuver by which a Senate majority changes the chamber's effective rules **by simple majority** — without the two-thirds vote that formally amending the standing rules requires. The mechanism is a point of order: a senator raises one, the presiding officer rules against it under existing precedent, the majority **appeals and overturns the ruling 51–49**, and the new interpretation becomes binding precedent. The rules on paper never change; what the rules *mean* does. Four detonations define the modern Senate: **November 2013** (Reid — killed the 60-vote threshold for executive-branch and lower-court nominees), **April 2017** (McConnell — extended it to the Supreme Court, seating Neil Gorsuch), **April 3, 2019** (cut post-cloture debate on district judges and most executive nominees to two hours), and **September 2025** (permitted unlimited **en bloc** confirmation in a single vote). Each was justified as a response to the other party's obstruction; each was permanent; each moved power to whoever holds 51 seats. The legislative [[Filibuster]] is the last threshold still standing. ⚠️ **The September 2025 change is routinely reported as one 53–45 vote on September 11. It was two separate reversals of the chair on two different questions.** On **September 11, 2025** the chair was overturned **45–53** on the question of cloture for an *executive resolution* bundling nominations; on **September 17, 2025** the chair was overturned **47–52** on the question of cloture for the *nominations themselves, moved en bloc*. The first made the package votable; the second made the package confirmable. The exclusions are written into the text of the point of order: everything "other than those on level 1 of the executive schedule under 5 U.S.C. 5312 or article III judges" — i.e. the 21 Cabinet-rank seats and **every Article III judge** still travel one at a time.
