# Musk Companies Labor Litigation
This page tracks employee and government employment cases against [[Elon Musk]]'s companies ([[Tesla]], [[SpaceX]], [[X (Twitter)]], [[xAI]] and [[Neuralink]]), with current status for each. It is the index; the major cases have their own pages. Statuses are as of **September 27, 2026**.
## The pattern
Across five companies and roughly a decade, the cases resolve in one of three ways, and almost never with a final judgment the plaintiff collects in full:
1. **Attack the forum.** When a federal agency brings the case, the company challenges the agency's constitutional authority to hear it: the NLRB's judges and board members in *[[SpaceX v. NLRB]]*, DOJ's immigration judges in *[[United States v. SpaceX]]*. When workers bring it, the company moves to compel arbitration. Where arbitration fails, as in the harassment cases escaping it under the [[Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act]], the cases reach court.
2. **The government leaves.** After January 2025 the federal side of the ledger emptied out. DOJ dropped its SpaceX hiring case with prejudice. The [[National Mediation Board]] moved SpaceX under the [[Railway Labor Act]] and the NLRB dismissed its complaint. The [[EEOC]] took its Tesla case into confidential mediation. All three came after January 2025: one while Musk was running [[DOGE]], and two within a year of his departure. The vault records the overlap and does not claim causation.
3. **Settle before the next jury.** *[[Diaz v. Tesla]]* after two trials, the first Tesla sexual-harassment case, three named plaintiffs in *Vaughn*, the fired Twitter executives, the age-discrimination class. All settled confidentially.
The live exception is the one case that depends on neither a federal agency nor individual plaintiffs: California's own race-discrimination suit against Tesla, **on trial since September 21, 2026**.

| Fremont sexual-harassment suits | 2021 onward, Cal. state courts | Sexual harassment, retaliation | First settlement (Tyonna Turner) May 2024, terms undisclosed; at least six others were pending then; a federal judge rejected Tesla's bid to force arbitration under the EFAA |
| HR and security staff suit (Murray et al.) | Aug 2025, federal | Retaliation, wrongful termination, failure to prevent discrimination | Six former HR and security staff, led by former security chief Ozell Murray, filed a 159-page complaint describing slurs, nooses, drugs, weapons and assaults at Fremont, and Musk's "hands-on" role in HR decisions. Pending. |

## SpaceX
| Case | Filed | Claims | Status |
|---|---|---|---|
| [[SpaceX v. NLRB]] | 2024, S.D. Tex. → 5th Cir. | Firing eight engineers over a 2022 open letter criticizing Musk; SpaceX's constitutional counterattack on the NLRB | 5th Cir. froze the NLRB case (Aug 19, 2025); NMB placed SpaceX under the RLA (Jan 14, 2026); NLRB dismissed for lack of jurisdiction (Feb 2026). Firings never adjudicated. |
| [[United States v. SpaceX]] | Aug 2023, DOJ/OCAHO | Refusing to hire refugees and asylees (2018–22) | Enjoined by S.D. Tex. on Appointments Clause grounds (Nov 8, 2023); DOJ dismissed with prejudice (Feb 20, 2025) |
| Holland-Thielen v. SpaceX | June 12, 2024, removed to C.D. Cal. | Sexual harassment and retaliation. The same eight fired letter-writers allege a sexualized workplace culture, including conduct by Musk personally. | District court denied SpaceX's motion to compel arbitration under the EFAA; SpaceX appeal pending at the 9th Cir. (No. 25-4811; amicus briefs Feb–Mar 2026) |
| Dopak v. SpaceX | 2024, L.A. Super. Ct. | Sex discrimination, harassment, coerced relationship with a supervisor, pay gap, retaliation | Arbitration denied (Oct 2024); California Court of Appeal affirmed (Nov 2025); proceeding in court |
## X / Twitter
| Case | Filed | Claims | Status |
|---|---|---|---|
| McMillian v. Musk | July 2023, N.D. Cal. | About $500M in unpaid severance for roughly 6,000 laid-off workers (ERISA) | Dismissed 2024; on appeal (9th Cir. No. 24-5045); tentative settlement announced Aug 2025; stalled by Jan 2026 in a dispute between plaintiffs' law firms |
| Agrawal et al. v. Musk | March 2024 | $128M in severance for fired executives Parag Agrawal, Ned Segal, Vijaya Gadde and Sean Edgett | Settled Oct 2025, terms undisclosed |
| Zeman v. X Corp | 2023, N.D. Cal. | Age discrimination in the Nov 2022 mass layoff | Judge Susan Illston let about 150 workers aged 50+ proceed collectively (Sept 2024); later settled (Law360). Companion sex- and disability-discrimination suits were dismissed in Aug 2024 with leave to amend. |
## xAI
| Case | Filed | Claims | Status |
|---|---|---|---|
| Kim v. X.AI Corp. | June 9, 2026, Santa Clara Co. Super. Ct. (No. 26CV495445) | Whistleblower retaliation (Cal. Labor Code § 1102.5), wrongful termination. Early engineer Devin Kim says he was fired in September 2025, days before a planned presentation, after repeatedly warning that Grok lacked safeguards against discrimination, misinformation and weapons instructions. He says co-founder and supervisor Jimmy Ba told him "AI will kill us all anyway" and would "rather release an unsafe model than a poor-performing one." **SpaceX is a co-defendant** as xAI's parent. | Pending. Seeks restored equity, compensatory and punitive damages. Filed just before the SpaceX IPO. A test of whether [[AI Safety]] warnings count as protected whistleblowing. |
**The other direction.** xAI has also been the plaintiff against former staff. It sued engineer Xuechen Li on August 29, 2025, alleging he copied Grok trade secrets before leaving for [[OpenAI]], and sought an order barring him from working there. Its companion suit accusing OpenAI of poaching staff to obtain trade secrets was dismissed in February 2026, then dismissed again **without leave to amend** on June 15, 2026. Judge Rita F. Lin wrote that holding otherwise "would potentially expose employers to liability any time they inquire about a candidate's past work."
## Neuralink
| Case | Filed | Claims | Status |
|---|---|---|---|
| Short v. Neuralink | June 14, 2024, Alameda Co. Super. Ct. (No. 24CV079691) | Animal-care lead Lindsay Short says she was scratched twice (2022, 2023) by rhesus macaques carrying herpes B while lacking adequate protective gear, and that the company resisted reporting her injuries to the USDA and [[OSHA]]. She says she was handed termination papers the day after disclosing her pregnancy to HR (June 2023). 15 causes of action including pregnancy discrimination, failure to accommodate and retaliation; about $10M sought. | No ruling or settlement found in public reporting as of Sept 2026 |
## What this page is for
Two things the vault tracks elsewhere meet here. The [[Unitary Executive Theory]] campaign against independent agencies, culminating in *[[Trump v. Slaughter]]*, was argued in the abstract as a question of presidential power. In these cases it was used as a defense in ordinary employment disputes. And the [[Defense Tech Conflicts of Interest]] frame, a contractor's CEO inside the government that regulates and pays his companies, has a labor-law version: the federal agencies that had open cases against Musk's companies have since dropped them, lost jurisdiction over them or moved them into confidential mediation.
