# Influence Peddling
Trading on access to power for private gain — selling, or renting out, one's relationship with decision-makers. Influence peddling is the gray zone between [[Lobbying]] (legal, disclosed advocacy) and [[Corruption]] (bribery's illegal quid pro quo): the influence peddler monetizes *proximity itself*, usually without any explicit exchange that prosecutors could charge under the bribery statute.
## Why the line matters
U.S. bribery law (18 U.S.C. § 201) requires a specific *quid pro quo* — this official act for that thing of value — and the Supreme Court has narrowed "official act" further (*McDonnell v. United States*, 2016). Everything short of that line is a market: consulting retainers for former officials, speaking fees, board seats, foreign sovereign investments in the businesses of presidential relatives, and "strategic advice" contracts that never trigger [[Lobbying]] disclosure. The influence industry's premium product — access — is precisely the thing the law does not treat as corrupt.
## Forms
The access economy runs through several standard vehicles: the [[Revolving Door]] (officials cashing in relationships after leaving office); family-member enrichment (foreign deals with presidential relatives — [[Jared Kushner]]'s $2B Saudi sovereign-wealth investment after leaving the White House, or the Hunter Biden board seats that Republicans spotlighted); pay-for-access events (donor dinners, club memberships at a president's own properties); and unregistered "consultants" whose value is a phone that gets answered (see [[Shadow Lobbying]]). At industrial scale, sustained influence peddling shades into [[Regulatory Capture]].
## In the current era
The [[Second Trump Administration]] period has made proximity pricing unusually visible: the record 2025 lobbying market concentrated its gains in firms staffed by the president's former partners and fundraisers (see [[Lobbying Hub]]), while crypto ventures, memecoin purchases, and foreign sovereign deals tied to the first family created access channels entirely outside the disclosure system.
