# FARA The **Foreign Agents Registration Act** (1938) is the US federal law requiring individuals and organizations acting as agents of foreign principals to register with the Department of Justice and disclose their activities, relationships, and financial arrangements. FARA violations are a recurring thread across the [[Russia]] record and the broader Foreign Influence section of this KB. > [!note] Ledger > The firm↔foreign-principal crosswalk — which K Street firms represent which governments, verified registrant numbers, country spend, and the 2025–26 enforcement whipsaw — lives at [[FARA Registrant Map]]. ## Purpose and Requirements FARA was originally enacted to counter Nazi propaganda operations in the United States. It requires anyone who acts as an "agent of a foreign principal" — performing political activities, public relations, lobbying, or information dissemination on behalf of a foreign government, party, or entity — to register with DOJ, disclose their foreign principal, and label any informational materials distributed on their behalf. The key requirements: register within 10 days of agreeing to act as a foreign agent, file detailed semi-annual reports, label all distributed materials with the foreign principal's identity, and maintain records of all activities. ## FARA in the Russia Record FARA violations appear throughout the Trump-Russia ecosystem: **[[Paul Manafort]]**: His decade of undisclosed work for pro-Russian Ukrainian President [[Viktor Yanukovych]] and the Party of Regions ($60M+) was never registered under FARA. Manafort retroactively filed FARA registration in June 2017, after the investigation began. His failure to register was among the charges in his indictment. **[[Michael Flynn]]**: Failed to register for lobbying work on behalf of Turkey (a separate foreign influence vector). He retroactively registered in March 2017. Flynn's FARA violation was cited as part of the broader pattern of undisclosed foreign contacts. **[[Maria Butina]]**: Pleaded guilty to conspiracy to act as an unregistered foreign agent — operating on behalf of the Russian government through the NRA without FARA registration. Her case was prosecuted under the related statute 18 U.S.C. § 951 (acting as an agent of a foreign government) rather than FARA itself. **[[Tenet Media Russian Influence Indictment]]**: The September 2024 SDNY indictment charged RT operatives [[Kostiantyn Kalashnikov]] and [[Elena Afanasyeva]] with FARA violations for covertly funding American content creators ([[Tim Pool]], [[Benny Johnson]], [[Dave Rubin]]) through [[Lauren Chen]]'s [[Tenet Media]] without registering as foreign agents. The $10 million funneled through a fictional investor represented a new frontier in FARA evasion. **[[RT]]**: Required to register under FARA in November 2017, acknowledging its function as a Russian state media operation in the United States. ## The Enforcement Problem FARA has historically been under-enforced. Between 1966 and 2015, DOJ brought only **seven criminal FARA cases.** Enforcement surged after 2016 — driven by the Trump-Russia investigation's exposure of widespread unregistered foreign agent activity — but the law's structure still makes prosecution difficult: - The "agent" definition is broad enough that many lobbyists and consultants can argue they are not truly "agents" of a foreign government - The line between legitimate foreign policy consulting and covert foreign agent work is often blurry - Retroactive registration (filing after being caught) has historically been accepted as a remedy, reducing deterrent effect - The Tenet Media case shows how covert funding structures can circumvent FARA's disclosure framework entirely ## Beyond Russia FARA is relevant across the Foreign Influence section of this KB, not just Russia. Undisclosed lobbying for [[Saudi Arabia]], [[UAE]], and other foreign principals follows the same pattern: foreign money and influence entering American politics through intermediaries who fail to register. ## Significance FARA is the legal mechanism designed to make foreign influence operations visible. The pattern across the Russia record — Manafort's decade of unregistered Ukraine work, Flynn's undisclosed Turkey lobbying, Butina's unregistered NRA operation, Tenet Media's covert funding structure — demonstrates both the law's importance and its limitations. Every major foreign influence operation documented in this KB involved FARA violations, and in every case the violations were detected only after the damage was done.
