# Colorblindness
The doctrine that the Constitution forbids the government to classify by race for any purpose — drawn from Justice Harlan's dissent in *Plessy v. Ferguson* ("our Constitution is color-blind") and made the majority position by *[[Students for Fair Admissions v. Harvard]]* (2023), which ended race-conscious admissions. In the vault it is the right's rival frame to [[Affirmative Action]] and the argument that race-conscious remedies for [[Segregation]] are themselves "the new segregation"; critics answer that a rule blind to race is blind to the effects of a system built on it. See [[Pacific Legal Foundation]] for the litigation.
